VA Academy Guide: Your First Day – Client Asks for a W-9

Learning Objective

Understand the difference between Form W-9 and Form W-8BEN so you can respond appropriately during client onboarding.

Scenario

Client:

"Welcome to the team! Please complete and send me your W-9."

As a Virtual Assistant in the Philippines, what should you do?

Step 1: Don’t Panic

Many U.S. clients automatically ask every contractor for a W-9. This doesn’t always mean they know you’re an international contractor.

Before completing anything, determine whether you’re a U.S. person or a non-U.S. person.

Step 2: Know the Difference

Form

Who Uses It?

W-9

U.S. citizens, U.S. residents, and U.S. businesses

W-8BEN

Individuals who are not U.S. citizens or residents and provide services to U.S. companies

If you live and work in the Philippines and are not a U.S. taxpayer, you will generally use Form W-8BEN, not Form W-9.

Step 3: Respond Professionally

Sample message:

Hi [Client’s Name],

Thank you! I wanted to let you know that I’m an independent contractor based in the Philippines. Since I’m not a U.S. taxpayer, I believe the appropriate tax form is Form W-8BEN rather than Form W-9.

Please let me know if you’d like me to complete and send the W-8BEN.

Step 4: Complete Form W-8BEN

The client may send you a blank W-8BEN, or you can download the latest version from the IRS website.

Typical information you’ll enter includes:

  • Full legal name
  • Country of citizenship
  • Permanent address
  • Mailing address (if different)
  • Foreign tax identification number (if applicable)
  • Date and signature

Complete the form accurately, sign it, and return it to your client.

Why Does the Client Need This?

U.S. companies collect tax forms from contractors to document their tax status.

  • W-9 confirms the contractor is a U.S. person.
  • W-8BEN certifies that the contractor is a foreign individual and may qualify for certain tax treaty benefits, if applicable.

Common Mistakes to Avoid

❌ Filling out a W-9 when you are not a U.S. person.

❌ Using someone else’s Tax Identification Number (TIN) or Social Security Number.

❌ Leaving required fields blank.

❌ Sending incomplete or unsigned forms.

❌ Providing tax advice to clients or other freelancers.

VA Best Practices

  • Read every onboarding document carefully.
  • Ask questions if you’re unsure which form is required.
  • Keep copies of signed tax forms for your records.
  • Submit forms promptly to avoid delays in payment.
  • Protect your personal information by sending documents through secure channels.

Quick Quiz

1. A client asks for a W-9, but you’re a Filipino VA. Which form is generally appropriate?

A. W-2
B. W-9
C. W-8BEN ✅
D. 1099-NEC

2. True or False: A W-9 is generally used by non-U.S. contractors.

Answer: False.

Key Takeaway

As a Virtual Assistant working with U.S. clients, it’s important to understand the purpose of tax forms. If you’re a non-U.S. contractor, you’ll generally complete Form W-8BEN instead of Form W-9. When in doubt, communicate professionally with your client and seek clarification rather than submitting the wrong form.
